Comprehensive changes in the state plumbing code
for septic systems designed for residential and small-
scale commercial development are being challenged
in a lawsuit filed by the town of Caledonia in Racine
County, municipal associations and environmental groups……
The suit seeks an injunction to prevent Comm 83 from
going into effect. It also seeks rulings that code changes
are invalid because The Department of Commerce
exceeded its authority in passing it and that codes do
not comply with environmental regulations.
Current does for septic systems rely on operating with
a 36-inch zone of unsaturated soil above groundwater or
bedrock. Comm 83 decreases the soil depth to 24 inches.
The 12-inch difference will open 8.9 million acres statewide
previously closed to development and encourage unsewered
development in areas without urban sewer and water service,
the suit claims…….
Mike Corry, a Commerce Department administrator who has
helped develop Comm 83, disputes the claim that it will
contribute to urban sprawl. Instead, it will facilitate in-fill
development, he said. “It will use existing, proven technologies
to allow development to occur in subdivisions that didn't permit
houses to be built on particular lots because they couldn't use
certain treatment systems under the old code. Under the new code,
there will be more intense use of those vacant lots. And I ask, what
public purpose does it serve to artificially bar the owner of the lot
from putting a house on it?” Corry said. The new treatment systems
are no more complex or difficult to maintain than ones allowed under
the current code, Corry said. Municipal officials are mistakenly
relying on the state's plumbing code to control growth, he added.
Instead, they should manage growth through proper zoning, he said.

the rural nature of our community and the amount of new

DID YOUR BASEMENTS GET WET THESE PAST FEW WEEKS?
A recent article in the Sunday Milwaukee Journal addressed
the problem of recently wet basements: 'May's heavy rains
have elicited a torrent of homeowner wet-basement complaints
to companies and attorneys, many wrongly assuming structural
defects when the real problem is poor maintenance, says Charles
Weber Consulting of Oak Creek. “I've had about 150 calls, mostly
from people who bought homes last fall or winter and experienced
water in their basement in the first heavy rain,” said owner Charles
Weber. “They're upset, they're emotional. They paid the most
money of their lives to buy this house and now, they think somebody
screwed them. Some called on referral from their attorneys. But I'd
say in 80% of the cases, we're talking maintenance problems.”
“It comes down to downspouts, gutters and grades. Look at those
before you take any action,” he advised. Gutters should be free of
debris, soil should be sloped at least one inch per foot downward from
the house, and downspouts should extend at least six feet and
preferably eight feet from the house, he said. Downspout elbows
should be two feet or higher above ground. “Many people have
them lying on the soil, where water can flow backward toward the
house,” he said.
Weber, a foundation expert for the Wisconsin Association of
Home Inspectors, said, “people should look at the home inspection
report they got when they bought the house. It probably tells them
what they needed to do on all this – they just didn't understand it or
failed to do it.
