DID YOU KNOW THAT FHA IS EASIER TO USE IN RACINE COUNTY?
The highest mortgage for a single family home is now $120,175 and the highest for a two-family is now $147,408. These numbers are up considerably from the "under-$100,000" figures that we used to deal with. If you want more information on FHA, call a loan officer, e-mail to me, or go to my web site and go to the button for HUD on the real estate page.

WHAT IF THE APPRAISAL IS LOW ON THE PROPERTY YOU ARE PURCHASING?
QUESTION: If a low appraisal comes in, does this give the buyer the right to claim that the financing contingency cannot be met?
ANSWER: The financing contingency is designed to allow the buyer to find satisfactory financing. The buyer has the duty to use a good faith and due diligence in completing the terms of the contract, including seeking financing per the terms of the contract.

If the buyer accepts financing and submits the loan commitment to the seller, even if it is subject to an appraisal, the buyer has fulfilled the loan commitment requirement and has assume the risk of the property appraising at the proper value.

If, in addition to the financing contingency, the buyer requires an appraisal contingency, it should be drafted into the original offer to purchase. The parties may, by amendment, agree to add an appraisal contingency if the buyer is unwilling to remove the financing contingency without this protection. LEGAL MATTERS
ADDITIONAL LEAD-BASED PAINT REGULATIONS KICK IN JUNE 1, 1999
Beginning June 1, 1999, property management firms, landlords and renovation contractors will be required to distribute lead-based paint notification pamphlets before beginning repairs or renovation work in any buildings constructed prior to 1958. Exempted from the requirement are minor repairs and maintenance activities (including minor electrical and plumbing work) that disrupt two square feet or less of painted surface per component (de minimus rule). Violators may be subject to civil penalties of up to $25,000 per day per violation and criminal penalties of up to $25,000 per day and imprisonment for up to one year for each violation.

CAN'T FIND THE ADVERTISED RATES?
We often hear that people see rates advertised in the paper or on the web and they can't find those terms. Sometimes those rates are "teaser" rates, somewhat like the airlines advertise to get you to call. Sometimes the rates in the newspapers are taken from national rates quotes and are not matched in the market area within which you are working. Other factors come into play, too. If you have a co-buyer who won't be living in the property or if you are buying property as investment you will usually be asked to pay about 3/8 percent higher and will likely be asked to put 25% - 30% down instead of the 5% down for owner occupied. EXURBIA
There is a new word out there! "EXURBIA" and it sounds like that is where we live!! According to the Milwaukee Journal Sentinel, the "Exurbs" are the land beyond the suburbs. The Exurbs are where the big growth in property value in the metro area has occurred during the last decade, according to a new report from Milwaukee's Public Policy Forum. The growth patterns in unincorporated towns has prompted a state legislator (Rep. Carol Owens-R-Oshkosh) to propose a new law giving the largest unincorporated towns new legal powers against annexation.
